Kent Bergh, being duly sworn, deposes and says,
1. I am a medical doctor, currently engaged in family practice at the North Memorial Family Practice Clinic in Minneapolis, Minnesota.
In 1974, I was employed as a medical doctor at the Rosebud P. H. S. in South Dakota.
2. In 1974, I was subpoenaed to appear before the Rosebud Sioux Tribal Court in a proceeding relating to the disbarment of William Janklow.
3. I appeared before the Rosebud Sioux Tribal Court on October 31, 1974 and brought with me copies of medical records from the Rosebud P. H. S. pertaining to Jancita Eagle Deer.
4. I have read a copy of a memorandum decision issued by the Rosebud Sioux Tribal Court wherein it is stated that "medical records from the Rosebud P. H. S. shows evidence of the attack against her and
quotes her as contemporaneously identifying Mr. Janklow as her assailant."
5. I have also read the affidavit of Larry B. Levanthal who stated: "a medical professional from the Rosebud P. H. S. also appeared and testified that medical evidence of an attack consistent with rape had..."
