U.S. Department of Interior Judge Frederick Lambrecht's 8/30/1976 letter to Administrator of Wagner Service Health Service citing affidavit from Eric Sheldahl mentioning rape of Jancita Eagle Deer on January 13, 1967

Dear Sir:

Subject: In the matter of the estate of Jeanette or Jancita Maria Eagle Dear Sheldahl, deceased unallotted Rosebud Sioux Indian of the State of South Dakota.

It is my responsibility as an Administrative Law Judge for the United States Department of the Interior, to probate estates of Rosebud Sioux Indians who die owning lands held in trust by the United States government. In this capacity, I am in the process of probating the subject estate.

Before a determination of heirs can be made, it is necessary that I have complete information concerning the family history of the decedent; i.e., marriages, children born to that decedent, etc. In this regard, I have furnished an executed affidavit by the decedent's former husband, Eric Sheldahl, wherein he states the decedent was raped on January 13, 1967, that as a result, a child was born to the decedent. Mr. Sheldahl states that he does not know the name or whereabouts of the child, but was quite sure it was a male. This child was possibly born somewhere around September 1967. Since, under the laws of the State of South Dakota, an adopted Child can inherit from his natural parents, it will be necessary for me to ascertain whether or not this child survived the decedent, and obtain the name of the child. I realize that the whereabouts are perhaps confidential, but perhaps you can advise me the agency through which the child was adopted. That agency could then be contacted, and some arrangements made for the inheritance of this child to pass to him. If this child died as an infant, or shortly thereafter, I would appreciate being advised of the date of death of the child.

Anything you can do to assist me in this matter will be very much appreciated. Enclosed for your convenience in replying, is a self-addressed envelope which requires no postage.

Sincerely yours,

Frederick W. Lambrecht
Administrative Law Judge
